Export Control Penalties

Penalties for ECL violations are strict and include both civil and criminal sanctions. Violations of the EAR may result in:

  • Fines up to five times the value of the illegally exported item or $1,000,000, whichever is greater
  • Imprisonment up to 10 years
  • Denial of export privileges
  • Seizure and possible forfeiture of illegally exported items, as well as their mode of transportation

Violations of the ITAR may result in:

  • Fines up to $1,000,000 per violation
  • Imprisonment up to 10 years
  • Revocation of exporting privileges
  • Seizure and forfeiture of exported item

Violations of the OFAC embargoes may result in:

  • Fines up to $1,000,000 per violation
  • Imprisonment up to 10 years

Please note that sanctions may apply to both the individuals and institution involved in the illegal export. Both BIS and The Department of State consider voluntary disclosure of a violation or potential violation is a mitigating factor in determining sanctions.
